Terms of Service

1) Acceptance of terms

By accessing, registering for, or using SellGram ("the Service," "we," "us," or "our"), you ("Creator," "User," or "you") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2) What SellGram is

SellGram is a platform that helps creators monetize Telegram channels, groups, and communities by enabling paid subscriptions, one-time access passes, and membership management. We provide the tools; you provide the content and the audience.

3) Eligibility

To use SellGram, you must have the legal capacity to enter into this agreement under the laws that apply to you. By using the Service, you represent that the information you provide is accurate and truthful, and that you will use the platform in compliance with applicable law and Telegram's terms.

4) Account registration and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that show signs of fraud, abuse, or policy violations.

5) Creator responsibilities

As a creator using SellGram, you agree to:

• Own or have the rights to all content you sell or distribute.
• Comply with Telegram's Terms of Service and Community Guidelines.
• Comply with all applicable local, national, and international laws — including tax, consumer protection, and data protection laws.
• Accurately describe your offerings, pricing, and what subscribers will receive.
• Honor the promises, refund terms, and access durations you advertise.
• Respond to reasonable subscriber inquiries and complaints.

6) Payments, fees, and payouts

Payments from subscribers are processed through a third-party payment aggregator that supports methods such as UPI, cards, netbanking, and wallets. We may change our payment provider from time to time. By using SellGram, you also agree to the terms of the applicable payment processor.

SellGram charges a flat 10% commission on each sale, as shown on our pricing page. This 10% is all-inclusive — GST and payment gateway charges are already covered within it, and nothing further is deducted from your earnings on that account. There are no monthly fees and no setup costs. Payouts are released to your linked account according to the schedule stated in your dashboard, subject to fraud checks and gateway settlement times.

The 10% commission covers GST and gateway charges on the platform fee itself. You remain responsible for reporting and paying your own income and other applicable taxes on your earnings. SellGram may issue tax-related documents where legally required.

7) Refunds and chargebacks

You are responsible for setting a clear refund policy and displaying it to your subscribers. You must honor any refund obligations under applicable consumer protection law, even if they go beyond your stated policy.

Chargebacks initiated by subscribers through their bank or card issuer may be deducted from your balance, along with any associated fees. Excessive chargebacks may result in account suspension.

8) Prohibited use

You may not use SellGram to create, sell, promote, or distribute:

• Illegal content, pirated material, or anything that infringes intellectual property.
• Sexually explicit material involving minors, non-consensual content, or any content prohibited by law.
• Scams, pyramid or Ponzi schemes, fake investment signals, guaranteed-return promises, or fraudulent services.
• Content promoting hate, violence, terrorism, or self-harm.
• Unregulated financial, medical, or legal advice presented as professional guidance.
• Malware, phishing links, or any content intended to harm users or systems.

You also may not: impersonate others, bypass access controls, scrape or reverse-engineer the platform, abuse APIs, or take any action that endangers our relationships with payment partners or Telegram.

9) Intellectual property

SellGram, including its branding, design, code, and written content, is owned by us and protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of your own content; by uploading it, you grant us a limited license to host, display, and deliver it to your paying subscribers as needed to operate the Service.

10) Service availability and changes

We aim for high reliability, but we do not guarantee uninterrupted or error-free service. Scheduled maintenance, third-party outages (including Telegram and payment gateways), security incidents, or force-majeure events may disrupt access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where feasible.

11) Suspension and termination

We may suspend or terminate your account if you violate these Terms, harm other users, expose us to legal or financial risk, or engage in fraudulent activity. You may stop using SellGram at any time by closing your account. Upon termination, outstanding payouts will be processed subject to fraud and compliance checks.

12) Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any specific income, subscriber growth, or business result. See our Disclaimer for more.

13) Limitation of liability

To the maximum extent permitted by law, SellGram and its team shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of revenue, subscribers, data, or goodwill — arising from your use of or inability to use the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amount of platform fees you paid to us in the three (3) months preceding the event giving rise to the claim.

14) Indemnification

You agree to indemnify and hold harmless SellGram, its owners, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or any applicable law.

15) Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, unless applicable consumer law requires otherwise.

16) Changes to these terms

We may update these Terms from time to time. If changes are material, we will notify you via the dashboard or email. Continued use of the Service after changes become effective means you accept the revised Terms.
